The  terms ‘Sketchbook Illustrated’ or ‘Illustrator’ or ‘Designer’  or ‘us’ or ‘we’ or ‘our’ refer to the owner of the company and the website, Alpesh Patel. We are registered in England and Wales under the registration number 2286004. The terms ‘you’ or ‘Client’ or ‘Customer’ refer to the user or viewer of this website. The term ‘artwork’ refers to the illustration or design work carried out or to be carried out.

The content of this website is for your general information use only. It is subject to change without notice.

You acknowledge that neither we nor any third parties provide any warranty or guarantee as to the accuracy, timeliness, performance, completeness or suitability of the information and materials found or offered on this website for any particular purpose. Buying Goods

By buying goods through the Sketchbook Illustrated website you acknowledge you have formed a contract for purchase with us, and you understand that any products ordered are for your own private or domestic use. A parent or guardians consent must be required by any minors under the legal age (18 or 21 depending on location) to purchase from us online. Every purchase you make shall be deemed as being performed in Coventry. The laws of England and Wales shall govern every aspect of contractual agreement concerning purchases made from the Site.

All prices include sales taxes (where applicable) unless otherwise stated, and charges for shipping. Processing of pre-orders may begin earlier than the release date to ensure that orders can be shipped to you in time for the release date.

Sketchbook Illustrated will arrange shipment of all ‘in stock’ items within 48 hours of receiving your order. Your order may be delayed for reasons including, but not limited to public holidays, item is currently out of stock or our suppliers are experiencing a high volume of orders. In these events we cannot supply exact dates of when goods will be back in stock; we can, however, give an approximate timescale.

The contract for the sale of any product will not subsist between you and Sketchbook Illustrated until we confirm that the product(s) have been dispatched to you by a confirmation email. This email amounts to an acceptance by us of your offer to buy goods from Sketchbook Illustrated. In the event of you not receiving the email, these terms still apply.

Our prices are monitored regularly but if for whatever reason we discover an error in the price of the goods you have ordered, we will inform you as soon as possible. If the error has been highlighted prior to your receipt of the confirmation email, we will cancel and refund your order.

You must have a valid email address to purchase from our site. You agree that the email address provided can be used as a means of communication, and you agree all notices made through email satisfy legal requirements that such notices be made in writing.

The confirmation email will consist of all relevant statutory information concerning your contract.

You must double check that all the details on this confirmation email are correct as soon as possible, print a hard copy of it and store it safely.

If you have difficulty receiving emails from us, it is your responsibility to advise us and rectify this situation. We recommend you add Sketchbook Illustrated to your ‘safe sender’ list, and check your internet security software does not block emails from us. If you still continue have problems receiving our emails, then please contact you Internet Service Provider who should be able to assistant you further.

 

Payment Method

Our website is integrated and verified with PayPal checkout. In order to ensure that your card is not being used without your consent, we will validate name, address and other personal information supplied by you during the order process against appropriate third party databases including registered credit reference agencies and fraud prevention agencies, who may keep a record of that information. By accepting these terms you consent to such checks being made. We will process the data in accordance with the terms of our Privacy Policy which you should also read for further information. We assure you that all information provided by you will be treated securely and in accordance with the Data Protection Act 1998.

You acknowledge that all details you have provided whilst purchasing your goods from Sketchbook Illustrated are true and correct, the credit/debit card you are using is your own or you have consent from the owner and that there are sufficient funds to cover the cost of the goods ordered.

You are responsible for keeping your PayPal login details safe and secure. You must make every effort not to disclose this information to anyone. If it is compromised you must change it. You may not transfer or sell your email address to anyone, nor permit, either directly or indirectly, anyone to use your email address or password in case of misuse.

If there are any changes to the details you have supplied, it is your responsibility to inform Sketchbook Illustrated immediately.

All purchases are non-transferable.

 

Using Social Media

You acknowledge that any review, comment, feedback or rating which you leave us may be published and agree that it may be displayed for as long as we consider appropriate. Also, the content may be syndicated to other Sketchbook Illustrated publications.

If any third parties takes a claim or action against us, arising out of or in connection with any review, comment, feedback or rating you have given us, including the violation of their privacy or intellectual property rights, you agree to indemnify and hold us harmless.

You grant Sketchbook Illustrated a royalty-free worldwide licence to use or edit any review, comment, feedback or rating posted by you. We reserve the right to publish, edit or remove reviews without notifying you.

 

Cancellation

You may cancel the contract no later than seven working days after the day you received the product by emailing a notice of cancellation ensuring that you quote your name, address and reference number.

If you have already received the goods, follow our returns authorisation procedure – contact us via email or phone. We will provide you with a returns authorisation number and details on how and where to send your item. Wrap your item(s) securely with your original invoice and returns authorisation number. You must ensure all goods are packed appropriately to avoid any damage. If you fail to take care of the goods before they are returned to us resulting in damage and/or deterioration, you will be charged for the reduction in value.

Items excluded from the right to cancel include but are not limited to the following: personalised or goods made to specification and vouchers that have expired.

for any charges incurred in returning the goods to Sketchbook Illustrated or if you fail to return good you will be liable for any charges incurred in relation to its collection.

We will refund your credit/debit card or PayPal account once we have received and processed the item within 30 days of notice of cancellation.

 

Damaged or Incorrect Items Sent

In the unlikely event you receive goods which you did not order, are faulty or are a different quantity than stated on your order form, Sketchbook Illustrated will make good any shortage or non-delivery, replace any damaged or defective goods or refund you the amount you paid for the goods in question. Please notify us in writing within 28 working days of delivery of the goods. We will email you a returns authorisation procedure stating where and how to send your items back to us. This does not affect your statutory rights.

Multi-buy items can be returned to us if they are damaged or have a defect. We are able to offer a replacement for faulty items, but due to the nature of these promotions, we cannot offer you a refund for the main or qualifying item alone.

On receipt of your return we will thoroughly check the goods for the damage stated. If the item is found not to be faulty, we will return it to you. You will be liable for the delivery charge and we will not refund any postage.

 

Gift Vouchers

Legitimate Sketchbook Illustrated vouchers that have been purchased from our website have a claim code consisting of 16 digit combination of letters and numbers.

Gift vouchers can be used on personalised commissions but not on products sold on this site. Any purchase made will be in GBP sterling.

If the total of the commission is over the value of the gift voucher, the difference must be paid by another means. If the full amount is not redeemed, the balance will be given in the form of a new voucher. ‘Change’ vouchers are subject to the same terms as standard vouchers and are additionally not assignable or transferable.

Gift vouchers cannot be used to purchase other gift vouchers or used in conjunction with any other discounts or promotions.

Vouchers and ‘change’ vouchers expire after one year from the date of issue.

Gift vouchers have a cash redemption value of 0.001p and are not transferable or assignable.

More than one voucher can be used at one time but cannot be used in conjunction with any other offer or promotions.

 

Liability

Sketchbook Illustrated does not exclude or limit any liability for personal injury (including sickness and death) where such injury results from our negligence or wilful default or from fraudulent misrepresentation.

We do not accept any liability for any errors and omissions and reserve the right to change information, prices, specifications and descriptions of listed good, products and services.

Sketchbook Illustrated will do its best to correct errors and omissions as quickly as practicable after being notified of them.

To the fullest extent permitted by law, Sketchbook Illustrated is providing this site and its contents on an ‘as is’ basis and makes no (and expressly disclaims all) representations or warranties of any kind, express or implied, with respect to this site or the information, content, materials or products included in this site including, without limitation, warranties of merchantability and fitness for a particular purpose. In addition, Sketchbook Illustrated does not represent or warrant that the information accessible via this site is accurate, complete or current.

You and Sketchbook Illustrated will only be liable under these Terms for losses that are a reasonably foreseeable consequence of the relevant breach of contract.

Products on this website are not for re-sale or distribution. All customers are limited to a purchase of 5 items of any one product. However, if you are a commercial organisation/company requiring a bulk order, please contact us at:enquiry@sketchbookillustrated.com or via our contact form.

Sketchbook Illustrated does not accept liability for any business loss (including loss of profits, revenue, contracts, anticipated savings, data, goodwill or wasted expenditure) or any other indirect loss, consequential loss, loss of data, loss of income or profit, loss of damage to property and/or loss from claims of third parties arising out of the use of the Site or for any products or services purchased from Sketchbook Illustrated when not using the products in accordance with these Terms and Conditions.

We do not accept any liability if you have any delay in delivery of products ordered due to any event outside of our reasonable control including but not limited to acts of God, war, flood, fire, labour disputes, strikes, lock-outs, riots, civil commotion, malicious damage, explosion, governmental actions and any other similar events.

We shall have no liability (including liability for negligence) for the acts or omissions of telecommunications service providers or for failures of or faults in their networks and equipment.

 

Miscellaneous

No waiver by us of any breach of these Terms shall be considered as a waiver of any subsequent breach of the same or any other provision.

All Intellectual Property Rights in the Site shall be owned by us. This includes all patents, database rights, copyright, design rights (whether registered or unregistered), trade marks (whether registered or unregistered) and other similar rights, together with the right to apply for the protection of any such rights.

It is a crime to provide incorrect information wilfully when purchasing from us. In the event discover you have used a false name or a known invalid credit card, you will be prosecuted to the fullest extent of the law. Sketchbook Illustrated tracks all electronic ‘fingerprints’ on every order placed to enable us and all legitimate crime prevention and prosecution authorities to trace individual users engaging in criminal activities on our website.

If you fail to make any payment to us when due, you breach the terms of this Agreement (repeatedly or otherwise). If when requested by us to do so, you fail to provide us within a reasonable time with sufficient information to enable us to determine the accuracy and validity of any information supplied by you, or your identity. If we suspect you have engaged, or about to engage, or have in any way been involved, in fraudulent or illegal activity on the Site.

Sketchbook Illustrated may amend these terms at any given time. It is your responsibility to make sure our terms are to your satisfaction when purchasing goods from us. If you do not agree to any changes to these Terms, then your only remedy is to cease using the Site.

These Terms supersede any and all other conditions, understandings, commitments, agreements or representations (except fraudulent misrepresentations) relating to your purchase, whether oral or in writing, and contain the entire agreement between Sketchbook Illustrated and you relating to your purchase. Sketchbook Illustrated advises that you print off and keep safe a copy of these terms and conditions once your order has been accepted by Sketchbook Illustrated. We will store a copy of the contract entered into by you with Sketchbook Illustrated. You are advised to read (and are responsible for reading) fully all information on this website.

If any provision of these Terms shall be held by any competent authority to be invalid or unenforceable in whole or in part, the validity of the remaining parts of these Terms and the remainder of the affected provision shall be unaffected.

These Terms are subject to the laws and exclusive jurisdiction of the laws of England and Wales.
